OnPoint TGS Plans Pty Ltd

These Terms & Conditions ("Terms") apply to all services provided by OnPoint TGS Plans Pty Ltd ("OnPoint", "we", "our", "us"). By engaging our services, visiting our website, or accepting a quote, you ("the client", "you", "your") agree to be bound by these Terms.
1. Services Provided
1.1 OnPoint TGS Plans Pty Ltd provides professional traffic management planning services including:
Traffic Guidance Schemes (TGS)
Traffic Management Plans (TMP)
Council submission assistance (optional)
Documentation support for permit approvals
1.2 We do not provide on-site traffic control personnel or physical traffic management equipment unless expressly arranged through third-party providers.
2. Turnaround Time
2.1 Our turnaround time is calculated per plan, and begins once:
All required project information is submitted
Full payment has been received and confirmed
2.2 Our standard business hours are Monday to Friday, 9:00 AM to 5:00 PM (excluding public holidays).
2.3 Typical turnaround times (within business hours):
TGS (Traffic Guidance Scheme): Delivered within 4 hours per plan
TMP (Traffic Management Plan): Delivered within 8 hours per plan
2.4 Requests submitted outside of business hours may experience slightly longer turnaround times, depending on plan complexity and availability.
2.5 We will confirm the estimated delivery time upon review of your request.
3. Quotes & Payment
3.1 All quotes are valid for 7 days from the issue date unless otherwise specified.
3.2 Upon quote acceptance, we will issue an invoice via email with a secure online payment link.
3.3 Payment can be made via:
Credit/debit card (online)
Direct bank transfer (details on invoice)
3.4 Full payment is required before any work begins. Delays in payment may affect delivery timelines.
4. Cancellations & Refunds
4.1 Cancellations made before work has commenced may be eligible for a refund, less an administration fee.
4.2 No refunds will be issued once work has commenced on your TGS or TMP.
4.3 OnPoint is not responsible for delays or plan rejections caused by inaccurate, incomplete, or late information provided by the client.
5. Revisions
5.1 Each plan includes one (1) minor revision at no additional cost.
5.2 Additional revisions or changes in scope may incur extra charges, depending on complexity.
5.3 Revisions requested due to feedback from councils or authorities may be included at our discretion.
6. Council Permit Applications
6.1 OnPoint can assist with council or authority permit submissions for the TGS or TMP plans we prepare.
6.2 This service is available as an add-on or as part of a package deal — please request this when placing your order.
6.3 While we aim to meet all submission requirements, permit approvals are solely at the discretion of the relevant authority, and we cannot guarantee approval.
7. Client Responsibilities
7.1 You are responsible for providing complete, accurate, and timely information about your project, including:
Site address and access details
Work scope, dates, and times
Traffic and pedestrian impacts
Utility or public transport involvement (if applicable)
7.2 Failure to provide the necessary information may result in delays, additional charges, or plan inaccuracies.
8. Implementation Disclaimer
8.1 OnPoint TGS Plans Pty Ltd is responsible for designing traffic plans only. We do not carry out on-site implementation.
8.2 The execution of TGS or TMP plans on-site must be performed by a licensed traffic management company or certified traffic control personnel, in accordance with all relevant regulations.
8.3 OnPoint accepts no liability for issues arising from how plans are implemented on-site, including:
Improper signage setup
Safety breaches
Inadequate personnel
Damage, injury, or loss caused by third-party implementation
9. Limitation of Liability
9.1 OnPoint accepts no responsibility for:
Delays or permit rejections by authorities
Consequences of inaccurate information supplied by the client
Implementation errors by traffic control providers
9.2 Our total liability for any claim is limited to the amount paid for the specific plan or service in question.
10. Intellectual Property
10.1 All documents, drawings, and digital files remain the property of OnPoint TGS Plans Pty Ltd until full payment is received.
10.2 Clients are granted a limited, non-transferable license to use the completed plan solely for the intended project and permit application.
10.3 Plans may not be copied, resold, modified, or reused without written permission.
11. Privacy
11.1 We collect personal and project information only as required to deliver our services.
11.2 Your information will never be sold or disclosed to third parties, except where necessary for authority submissions or legal compliance.
12. Governing Law
12.1 These Terms are governed by the laws of the state of Australia.
12.2 Any disputes arising from these Terms will be subject to the jurisdiction of the courts of that state.
